Instagram Sweepstakes Terms and Conditions

TERMS OF PARTICIPATION AND CONDUCT OF THE DOCTOR MI! INSTAGRAM GIVEAWAY

These terms and conditions apply to all participants ("participants") of the DOCTOR MI! INSTAGRAM SWEEPSTAKES. By participating in the sweepstakes, the participant agrees to the terms and conditions and confirms that the statements made are correct.


1) Organizer of the contest
The contest is an event organized by Doctor Mi! GmbH, Widenmayerstr. 31, 80538 Munich ("DOCTOR MI!"). The contest is not affiliated with Meta (Facebook/Instagram), nor is it sponsored, supported, or organized by them. By participating in this contest, all participants release any claims or liability related to the competition. Meta is not available as a contact for the contest.

2) Eligible Participants
Eligible to participate are persons who have their residence in Germany, Austria, or Switzerland and are at least 18 years old and who have a mailing address in Order from Germany, Austria, or Switzerland. In addition, these people must be followers of https://www.instagram.com/doctormi/.

Multiple entries as well as participation by employees of Doctor Mi! GmbH are excluded from participation.


3) Exclusion from participation
DOCTOR MI! reserves the right to exclude participants from the contest who provide false information, manipulate the contest, attempt to manipulate it, or otherwise violate these terms and conditions. Furthermore, DOCTOR MI! has the right to modify, suspend, or terminate the contest prematurely if this becomes necessary due to force majeure or circumstances beyond the control of DOCTOR MI!. Any automated participation or other automated methods of participation will result in exclusion from the contest.


4) Profit, Participation, and Determination of the Winners
One of 3 signed sets of our Friends of the Brand Ed Westwick & Amy Jackson, each worth €350, will be raffled among all correct participants. The contest ends on 6.10.24 at 23:59 CET. Eligible to participate are all according to point 2).

The winner will be determined by random draw from all proper participants, or those who have properly fulfilled the participation conditions stated in the contest, by no later than 17.10.24. The winner will be notified via private message through the Instagram account and asked to provide their contact details (first name, last name, address, and date of birth). Only responses with complete information can be considered. The claim to the prize expires if the winner does not contact DOCTOR MI! within 2 days via the specified method with the complete information mentioned above; in this case, a new winner will be determined using the same procedure. The transfer of the prize to third parties, cash payment of the prize value, or exchange of the prize is excluded.

DOCTOR MI! reserves the right to replace the prize with other products of similar value if the mentioned/assigned prize is currently not or no longer available for reasons beyond the control of DOCTOR MI!.

5) Granting of rights by the winner
DOCTOR MI! intends to announce the winner by name in a winner post on Instagram in the story and/or posting on Instagram to announce the Facebook account of DOCTOR MI! (@doctormi).

6) Data protection
The participants' data will be stored exclusively to the extent mentioned under point 4 ("Determination of the Winners") and only for the purpose of conducting the contest. A participant has the right to request the deletion of their data at any time with effect for the future. A corresponding deletion request before the conclusion of the contest will result in exclusion from participation in the contest. The winners' data (except for the winner's post/announcement on Instagram) will not be passed on to third parties. All data will be deleted no later than one week after the conclusion of the contest (shipment of the prize(s)). Additionally, we point out that Instagram and Facebook collect participant data, over which DOCTOR MI! has no influence.

7) Disclaimer
DOCTOR MI! is not liable for damages caused by intentional or grossly negligent actions, during transport, or for damages resulting from slightly negligent breaches of obligations arising from the contest that enable the proper conduct of the contest and on whose fulfillment the participants may therefore rely. Liability is not limited in cases of personal injury and within the scope of the Product Liability Act. The above liability provisions also apply to breaches of duty by the legal representatives or vicarious agents of DOCTOR MI!. 

8) Other
Legal recourse is excluded.
The law of the Federal Republic of Germany applies. Statutory provisions restricting the choice of law and the applicability of mandatory consumer protection regulations, especially those of the EU member state in which the participant has their habitual residence, remain unaffected. In addition, the terms and conditions and guidelines of Instagram and Facebook apply. Comments that violate these or for which the participant does not hold the necessary rights/copyright are excluded from participation and thus from winning. The contest is in no way connected to Meta and is not sponsored, supported, or organized by Meta. Meta is not available as a contact for the contest. Should any of these provisions be or become invalid, the validity of the remaining participation conditions shall remain unaffected.
